Does it have to be exactly that model? There are plenty DS Lites around I think. My local Game had quite a few left yesterday.
I really feel for you and your little boy. If I spot any on my internet travels, I'll let you know.
Extra bit: Evidently, the Nintendo DS blue is not actually being made anymore, so you probably won't be able to get one after Christmas either. Best advice is get one of the Lite ones - can play the same games, and is a generally better model. Tell him Santa decided to get him an EVEN BETTER one cos he's been SUCH a good boy. Have you already paid in advance for this? If not, you could try Toys R Us or Argos where they will have plenty of stock and then give Gamestation the bird every time you pass.
If you have already paid/given a deposit, you will need to demand that the shop either fulfil their promise to you and get you the one you wanted now or refund you immediately so that you can make other arrangements. If they cause any more problems, speak to Consumer Direct, a government-backed organisation on the phone and on line who are specialists in this sort of thing and can advise you further. Would it be possible to just get one from wherever and then get your money back afterwards? I know it's a big expense but it may be too close to Christmas to sort this out.

It's really not the end of the world - there are so many amazing things out there for kids - he might be upset but he will forget about it soon enough!
Christmas is only one day of the year and the world will not fall apart if he doesn't get the Nintendo. You can always try to buy it afterwards - but please don't feel pressured into buying expensive ones on ebay - that's not what makes you a better mother or makes his life more special.
But maybe try breaking the news to him before the big day so that he can get used to it?

Get him a different colour and have Santa write him a letter explaining why he couldn't get that colour. And if it is okay with him. Otherwise mommy can return it and get the right colour after Christmas. Or that Santa has been busy with the Children of the world that are less fortunate and will get it for him in the new year. This is an opportunity for him to learn the true meaning of CHRISTmas and what Santa represents.

It's unlikely and unfortunate that you don't have any recourse other than to post your comments about Gamestation online.
If they had some sort of guarantee that you would receive this before Christmas, then there would be some kind of "or else" clause where they will give you something for not holding up their end of the bargain. I've never purchased anything from them so I don't know about this particular site. I know that a lot of them have good lawyers that put in clauses to protect them from litigation.
You may just want to buy some games for it and give them to your kid and tell him what happened and that as soon as it comes in, that he'll get it.

have you called around to allll the stores in your area? If you have family out of town could you call their stores and have your relative mail it to you if it is available elsewhere? I agree you should tell your son that another child needed it more. Based on you saying he still believes in Santa, I'd say he's under 8 yrs old. It is so easy to get him a bunch of other stuff, and he'd be just as happy I am sure. My son asked for lego Airport which is also out of stock and bazillions of dollars on ebay, so I am just getting him some other legos from santa. Maybe he'd be just as happy with an Xbox or similar? At least he didn't ask for Playstation 3, lol

that sucks about them not letting you know. but im sure his christmas is far from ruined. im sure if he's old enough for the nintendo ds, he's old enough to know you don't always get what you want, even from santa.
get him something else equally cool, its not the end of the world even if it is a horrible stroke of bad luck.
