I received a bag as a gift and i didn’t like it so i decided to sell it on eBay. I stated that it was a Louis vuittion bag, as it had Louis vuitton written all over it, i never stated that it was genuine as I wasn’t sure. Now the buyer wants his money back as he got it valued and tells me it isn’t genuine. Should i give him his money back

I think you should because you didnt clearly state what the item was. Your description was deceptive.

I think that if it is not a genuine Louis Vuitton bag, or if you were not sure if it was genuine or not,you should have stated that on the ebay ad. If the buyer has paid you a load of money for something he thought was genuine, and you knew or were not sure that it was not, then sorry, but it it a bit like false advertising, and you should take the bag back, refund the buyers money and re-list it as a copy. We all make mistakes and as long as yours was an honest mistake, apologise and explain to the buyer, and refund, then you know you have done the right thing.

Give him his money back - you said it was Louis Vuitton, he trusted your advert - you will get negative feedback otherwise and as it was a gift...you haven't really lost anything. Alternatively, if he paid by Paypal - offer a refund.. Always good to keep your customers happy. If he wants the full refund, get it back and advertise it properly next time. Look at it this way, if you browsed on ebay for a genuine item, bought it for a good price and then found it was a fake, how would you feel??
However, on the other hand, if you said in the advert that you didn't know if it was genuine, then you are covered...he took a gamble and lost.

Yes, I think you should. If you stated it was a Louis Vuittion bag, then there was a definite implication that it was genuine. Get the bag back and re-sell it as a Lous Vuittion imitation. If it was a gift, any money you make on it is a profit to you anyway.

Not sure is not a defence against selling fake goods on the internet. I know it was unintentional but it is better to protect your reputation in the long term.

Would also keep dialogue with buyer as cordial as possible to avoid dispute escalation. You gain a lot more brownie points than just a few dollars lost as it were.

If you did not say the item was not genuine, you should give the buyer a refund. If the buyer used paypal they can file a claim and paypal will make them send it back to you at that point you will be forced to give a refund.

Ok in the auction if you mentioned you were unsure about it and if you clearly stated that it Was Not Genuine..then I see no reason for a refund.However,if you failed to give the most important information..then it is only fair to refund him!!good luck//

You are essentially guilty of false advertisement. It's only your word against theirs that you didn't know about it. The only thing you can do is pay them back and apologise.
