Usually yes. Anytime you change the size of an opening in the width, you have to put a new header in. Doing this requires a permit in most areas around the nation. Whether someone actually does it is another story.

The larger cities will definitely require a permit.
A couple of points: fire departments have guidelines for minimum replacement window sizes to allow firefighters to enter through a window with an air tank and equipment, and when you sell your house, you may need to disclose the fact whether or not you pulled permits for the window replacements.

Rule of thumb is if the home improvement is more than $50, then yes you need a permit. Check with your local township code officer to be sure.

Why not just talk to your local building department? Tell them what you are thinking of doing. Since you will have to enlarge the opening, they may even give you some advice. Just remember that they are not really adversaries, but want to make sure that the job is done right. If you've never installed windows before, it may be to your advantage.
