I was raped, chose life, and the father needs to be contacted,due to heredity reasoning, does he have any rights over the child?

I am sorry to say but the supreme court is clear on this one. He is the father and has rights. If you contact him he will know where to find you and could assert his right.

I am a Father's Rights Advocate and have been fighting in the courts for Father's Rights for over 10 years and I do not like the fact that rapists get rights but they cannot single out a group like that it is discrimination.

If you need to contact this person for medical reasons or what ever have the court do it and have them put a TRO in place to keep him away from you... but if the child is his he does have rights.

In some states, if a man is CONVICTED (which doesn’t mean merely accused) of raping a woman his parental rights to any child resulting from that rape are automatically terminated.

For example:

North Carolina Statutes 14-27.2. First-degree rape.
(c) Upon conviction, a person convicted under this section has no rights to custody of or rights of inheritance from any child born as a result of the commission of the rape, nor shall the person have any rights related to the child under Chapter 48 or Subchapter 1 of Chapter 7B of the General Statutes.


Nevada Revised Statues 125C.210
1. Except as otherwise provided in subsection 2, if a child is conceived as the result of a sexual assault and the person convicted of the sexual assault is the natural father of the child, the person has no right to custody of or visitation with the child unless the natural mother or legal guardian consents thereto and it is in the best interest of the child.


However, that doesn’t hold true in every state, which doesn’t mean he would get custody or visitation but he would have the right to ask for it.

no way. while i am happy that you chose life, it is the wiser and humane choice, it was wrong of him to put you through such agony and not only is it forbidden by law, but its just common sense that a man like this could not be responsible enough to raise a child even for a portion of the time, so unless you allow it, there is no reason that this man should even be able to meet your child. he created a child with none of your consent, and caused you pain, and instead of helping you deliver this child or anything else, he chose to reamain.....er....just a rapist, not a fatherly figure at all. there is no reason that this father should have any more control over his child than any other child in the world. =)stay strong.

The rapist had no right over the child because the act was forcibly made without the consent of the mother.

A resounding; NO! If the scum bag rapist can be found he has the right to a speedy trial for doing what he did to you! He does not now nor will he ever have parental rights or visitation rights to your child.

If there was a conviction for rape no judge is going to accept an arguement for visitation rights or custody. It there was no conviction and he denies rape he may have rights just like any father.

no, was he charged? you may be able to sue or get some kind of financial support. Well at least here he does not. where do you live? Talk to civil law asssistance.
