baby is 2 weeks old and my daughter and husband are not living together and she's moving back home to nebraska

sorry ,the question is can she leave with the baby or does she have to get court permission to do so. and what if her husband dont let her leave?

So what is the question??? As far as out of state custody you would have to get premission from the court to take a child out of state_

whats the question? The baby is 2 weeks old who ever is granted physical custody determines where the child lives, Nebraska or else where. The parent who is not granted physical custody will have visitation rights but usually at that age or any age for that matter will not be able to take the child out of state unless its for extended weekends. I do not know of anyone whose had to turn over their infant child to someone to have them taken out of state. There is a such thing as supervised visitation if there is a concern the father or mother can not deal with the child during visitations. I have a 13yr old child and her father {my ex husband} is allowed to visit he but can not take her out of the home, my step daughter lives 7 hours away in another state and my husband is only allowed to take her out of state for extended visitations such as 3 day weekends, Christmas, thanksgiving, summer, and spring breaks.

I just read your additional details. If she has custody of the child even temporary until the final court hearing unless he's seeking custody she can leave the state. No court can force someone to live some place they do not want to live she will be required to inform him of where she is living and when she plans on moving. Its sad they have a newborn baby and have not been able to work out their problems. This situation would have been easier had she moved while still pregnant because the child would not have even been considered at that point since it was not outside of the womb.

She can leave with the baby, but the father can file for custody, and she will have to go back to the state for the court case.
