to some extent the judicial system must deal with issues that may be outside the precedents set before. in such cases they may be creating laws as they are deciding on specific cases. but for the most part they must rely on broad guidelines that have served humanity and our conciousness for centuries. unless im being naivee, which may certainly be the case. decree-->law-->punishment
