Yes. If your lease says payment is due on the first and after the 5th it's considered late, your landlord can start the eviction process on the 6th.

Read the lease and you'll have your answer.

The first thing would be to read your lease, it might outline due dates and eviction points. As far as it being your first time past due, that probably does not matter. In most places I would say 30 days past due is consider serious enough to begin eviction. You should mail out a check for any amount you have on hand today. At least you show an attempt to pay and if he accepts partial payment you may be able to catch up.

Yes, if the landlord wants to, he/she can evict you for being $1 behind. Typically, the landlord needs to give you an opportunity to pay your back rent, failure to do that and the landlord has every right to evict you and you don't have a legal foot to stand on.

Depends on what is stated in the contract, but normally it takes about 3 missed payment for eviction here in Texas.

technically they can evict you for being a day late if there isn't a clause about it in your contract.

I don't think so. It does depend on the state...most states you have until the 10th legally. After that you are considered late.
