2/3 of salary is based on 40 hours, 1/3 is 60 hours, which is what you need to get a full check. But if 1/3 of salary is not approved via agenda for up coming week it is denied, which is usually the case. A person can work a full week and still be left with 2/3 of pay. Is this legal?

Sounds illegal to me. FSLA (Fair Labor Standards Act) laws mandate that overtime be paid for any non-exempt employee who works over 40 hours. To be non-exempt you have to be fairly high up the chain in salary range. You don't say what kind of work you do, but I sure never heard of any line of work where that was the practice. Check with your local Labor Board and see what they have to say about it.

You should call up a labor lawyer. He might know exactly what you're talking about and know if its unlawful or OK.
