Ok so here's the issue... I have an older brother and he's not the greatest person in the world. He has a daughter who will soon be 1 year old. The baby's mama will not allow him to see her (which I agree with sometimes), but what I don't agree with is her keeping my niece away from everyone else in the family. WE are good people and love this little girl to death. So to get to the question... can I sue for Aunt's rights?

seriously i feel for you in my heart. My brother has three daughters by three women and i only get to see one of them. his reason for leaving is he wants a boy I hate my brother and he is going to leave the third girlfriend as well. You have to make nice with girlfriend. assure her that you won't disclose any information about her or the child to your brother and once she gains your trust she'll let you see her. All of my brothers ex girlfriends are good people they just want what is best for their babies. You have to let her know you are on her side. I have so much i could tell you but i don't want to take up the whole page if you want to talk to someone who's been there e-mail me i would be more than happy to help you. It will not be easy. Instead going by courts why not to try to talk with your sister in law. The Supreme Court recently agreed that parents have a fundamental right to make decisions about raising their children, but it did not agree that the permissive visitation statute was unconstitutional nor that allowing a non parent to petition for visitation rights would amount to an assault on the integrity of the family unit. But most states and court limits visitation rights to grand parents, step parents. Try to get information what is legal precedence in your state.

Yes it is because the father has ever right to see his daughter if he keeps asking to see her and the mother says no then the father can have full cusitdy but if he does not then he can go to jail for child abandenment.

Nope. Its mothers choice. Perhaps he is such a **** that the ex-wife wants nothing to do with the family and is moving on. Most likely the reason is anyone connected to him is a reminder.

If you really care about your niece, then respect her mothers wishes. Its tough.

There might ne a chance if you get a lawyer and fight for some type of visitation with her.. I would try talking with the mother first

not sure about aunts rights, but i know in some states, there is grand parents rights...its too bad that the lil one isnt allowed to get to know her family...good luck hun and happy holidays

I dont think so but you could try to talk to the mother nicely and maybe your could go to her house to see your neice.It's better than nothing....

no, i dont think you can, it is the mother's choice and judgement on extended family, although your parents could probably get grandparent rights...then you could visit with her at your parents house....
