Legal custody hadnt been established yet, but the kids were living with me and we were doing "life" with no support from the other party. While they were at the sitters, I got a phone call saying the kids were taken and I must go to court to see them again. I'm desperately looking for answers, legally and experientially. By the way, I am the father.

first, was it the mother who made the call? or her attorney? If it was her, then she has more problems than she wishes forbesides taking the kids without your permission and making threats over the phone. Hopefully you notified the police especially if the caller wasnt mom and you didnt recognize the voice. This will hurt her in court too. If you can afford an attorney, Id recommend getting one or contact your states legal aid assoc.if you cant. From what Ive read here you should have no problem gaining custody in court as she is unstable as a mom if she resorts to kidnapping. Legally you were responsible for those kids and she had no right taking them. The sitter should have contacted you before releasing them to anyone but you. Contact the police if nothing more they can give you some advice on where to turn from here. Keep a record of everything that goes on from here on as itll helpin court. Good luck

Call the police...she cannot remove the children without a court order. Then file paperwork to speed up the legal custody case and you'll have all the proof you'll need to gain full custody.

If legal custody hasn't been established yet I don't think it is considered abduction. I would get in contact with the authorities or a lawyer asap.

It is child abduction but I don't think they pursue it that much when its the parent that takes them. Its like when your car is vandalized, you can call the cops, but are they really going to be out looking for your car? Take the advce of the first person and contact child services ad a lawyer.

Call a good attorney asap..find out where your kids are...how they are and who are they with. You need to know these things to make sure they are safe. Ask alot of questions like..why were they taken?What can i do so this never happens again? Good luck

get a good lawyer. I think it's child abduction, but I'm not sure. As a mother I would be worried out of my mind, as I'm sure you are.

unfortunately if nothing was written in stone then there is nothing that u can do but pray that u get the kids back...its unfortunate that women like ur ex have to use their children as pawns in a divorce...good luck to u

I agree with cmfrtkeep...seek an attorneys advice on this one and that way you will get an answer instead of a guess.
