Fiction is any literature describing something that has never happened. Whether or not it will happen in the future is not part of the definition. Since the Earth has never been invaded by martians, War of the Worlds is fiction.
As for the actual question of whether it will happen in the future, the answer is no. Many probes have been sent to Mars, and we know by now that it is very cold, very dry and has no technological civilizations living on it (if there's any life on it at all it would be bacteria living deep under the surface, hardly the kind of organism to launch space bullets at Earth). Also, considering that we've been listening for alien radio signals for decades and still haven't found any, it is unlikely that any other technological civilizations exist within at least a few dozen light years of us. Finally, even if aliens do land, it is unlikely that they will attack us, and if they do attack is it is unlikely that we'll have time to realize what's going on before we're dead.

Fiction.
Interesting fact- it is because of the War of the Worlds that we have mandatory Station Identification breaks. War of the Owrlds was originally aired during a radio show and there were no breaks or interupptions the entire time. Many people really believed that it was really happening and so it caused mass chaos. After that they started requiring stations to break in every so often and identify themselves.

H. G. Wells' masterpiece is clearly a work of fiction. Now, of course there are elements of it that may come to pass, but that doesn't change the intent of the original piece.
In other words, just because it could become non-fiction, doesn't mean it's not still fiction.

The War of the Worlds is a science fiction novel written by H. G. Wells and published in 1898.
Depicting an invasion of the earth by extraterrestrials (Martians, specifically), the novel is commonly regarded as being the first to depict such a disaster. Since then, The War of the Worlds has entered popular culture, with a vast number of books, films, TV series and comic books using themes from this book, whether acknowledged or not. It is fiction. Great movie but still absurd. An advanced race of space aliens burying machinery underground for a million years so they can come back and take over the world with it? The original story made much more sense.
