I walked into a recently opened women's clothing store (a well-known and upscale national chain) and the saleslady did her best to explain why a sign, on a rack of various types of clothing with various prices, did not mean that everything on the rack was that price. The sign simply said SALE, and a certain dollar amount. It did not specify which pieces were on sale at that price. All items on that rack had tags with the non-reduced price. I was told that only a certain article of merchandise on that rack was priced at the amount stated on the sign. There were less than ten pieces available at the "SALE" price on a rack of at least 80 - 100 pieces. Some items on the rack were on sale for $10 more than the sign said, some were "Buy one, get one 1/2 off," but at the regular price, and some weren't reduced at all! When I asked why the prices weren't clearly marked, I was told that if I hadn't asked, I would have found out at check-out!

Usually, bait and switch occurs with advertised items in order to lure a customer in the store and when they get there, there is no item or it has sold out and offers another item (similar) at a higher price. I can completely underatnd about signage and how a lot of the times signage is unclear and the items under the signs are "not included". Some stores actually honor the price under the sign (I've asked in the past). Also, in large retail chains, Weights & Measures typically check in on them to make sure that this doesn't happen.

Don't forget, the Better Business Bureau keeps logs of companies that are caught with doing bait and switch.

If there is a sign on the rack that just says "SALE" and price, then everything that is obviously stocked on that rack is that price. If an item is out of place, then they can refuse the sale price. Next time, take a camera. If they refuse to honor the sign, then speak to a manager. You may have to threaten a lawsuit for false advertisement.
