During the recent ice storm,a branch (big enough to do damage) from my neighbors tree fell and damaged my fence. It will have to be replaced. I have called & left a message twice in the last 4 days with no response from them. What should I do? The house is section 8 so trying to contact just one owner is going to be work. Any advice would be greatly appreciated.

my insurance deductable is $1000.00 and the fence is probably 20 years old.

my husband and i had to trim the same tree because the limbs were hanging over our roof.we did this a few years ago and the property manager knew it. So he knew the tree was & still is a problem.

my sister in law ran into the same problem and unfortuately she had to go through her home insurance. The problem is that the deductable was so outrageous that they paid it out of thier own pocket

This is what my Insurance company told me(American Family)
If the tree was damaged or dead it is thier insurance. If the tree is healthly it is your insurance. It is an understanding between Insurance Companies. Sorry but good luck. My company with my deductable had to pay. Does not sound right but that is what happened.

Most cases you need to have documented proof that the owner was aware of a dangerous issue and did not do what was reasonable to protect your property. report it to your insurance, they will try to collect for you if it was their fault.
IMHO storm damage is caused by storms not neighbors. I would fix my fence myself, not hassle neighbor over something they did not do deliberately.

You are due Nothing! I know it's hard to hear but unless in the past you warned your neighbor about his tree than it is an act of God and you have no claim!

yes...or get your chain saw out and throw it all onto their fence! Nice neighbors, hey. They are responsible...just happened to one of my friends. The nieghbors who tree did the damage are calling it "an act of nature"...yes, but still not right!

turn it in to your home owners insurance....they have whole teams of beady eyed lawyers who will collect the loss.
