who wrote it first; Hinder or Jack Ingram?

Neither Hinder or Jack Ingram WROTE the song, it was penned by Brian Howes. check the album

It was Hinder. They released the album Extreme Behavior in 2005, while Jack Ingram didn't perform it until it got a bit bigger in 2006.

Austin Winkler (lead singer of Hinder) wrote the song about personal experience. He wrote it about an xgirlfriend calling him while his current girlfriend was in the room. Jack Ingram bought rights to sing the song because of its mainstream popularity. Austin Winkler wrote the song.

I entered it in yahoo search and only came up with Hinder.

I just wonder if the same song, performed by 2 different artists/groups at the same time, in 2 very different tempos...caould they both be Number one in their respective Charts? Because they are both great versions. As to who wrote it... Well only one could write it, if both performers are singing it, it may be a composition registered with ASCAP (American Society of Performers and Composers...I hope I got that right, it's been a while), from where both performers got rights to use it.
