This is fraud to deceive the insurance company. Whoever signed the death certificate is held responsible in this case as its his duty to verify a dead body exists, verify id and then sign the death certificate as authentic and reason for death. The state can only take the death certificate as real and authentic as the signee is sworn to uphold the truth in his oath vows a dead body exists. Whoever got the benefits should reimburse the insurance company due to fraud and whoever signed the cert. should lose his job for fraud. Find a probate attorney in the yellow pages

have you called a probate lawyer? They might know the answer to that one and would prolly give a free consultation

EDIT
try the yellow pages in the phone book, also a paralegal would be cheaper so give that a try. I don't know too much about this kind of thing tho.
