Literally, it means "Driving While Intoxicated."

In the U.S. exactly what it means could vary depending on your State and possibly even County.

In many states, DWI basically means the same thing as DUI (Driving Under the Influence). In some states (CA and TX come to mind), they are actually different charges with different possible penalties.

For example, I think that in Texas any minor found in possession of alcohol while operating a motor vehicle can be charged with DWI...regardless of blood-alchohol or breath test results. If he fails the breath test, then he may be charged with BOTH a DWI and DUI. Also keep in mind that, in some jurisdictions, DUI/DWI can carry both civil and criminal charges.

Base upon Texas Law a DWI or driving while intoxicated is if a person is observed operating a motor vehicle upon the public roadway while under the influence of a substance. That substance could be alcohol or some other drug. A first offense for a DWI is a class B misd. and is punishable with up to six months in jail and a $2000 dollar fine or both, plus your license will be suspended for a duration of not more than one year.

A DUI is driving under the influence. This charge is only filed if the actor is under 21 yoa and is operating a motor vehicle while under the influence of a substance. This is a class C misd. and is punishable with a fine of $500 to $2000 and a term in jail for up to 180 days or both and his license will be suspended for up to one year.

Yes a DWI (Driving While Intoxicated) is the same thing as DUI (Driving Under the Influence) which is now also known as OVI (Operating a Vehicle Under the Influence).

DWI means driving while intoxicated. This means that you are driving over the legal drinking limit, .08 in most states. DUI is driving under the influence. This means driving under the legal drinking limit, (under .08) but still having alcohol or drugs in you system but not technically drunk.

and

As I understand them it changes on the severity of you BAC.
