A Utah based company filed a lawsuit against the FDA and got the ban lifted in April 2005. The principle of the decision is that there are more deaths caused by prescription drug use, especially Viox, the FDA has found only 5 deaths caused by ephedria, so the ban was removed.

I don't know the exact FDA regulation number, but no law or amendment was ever passed.

They did not pass an AMENDMENT regarding ephedra. They may have passed a bill or the FDA may have retracted its approval, but no one amended the constitution regarding the sale of a drug.

I also do not think it was repealed, since this drug has been known to cause heart attacks, as far as I know, any pharmacy I go to won't sell it. Which is fine by me!

I don't think it was an ammendment as is was a Food and Drug Administration order -

And I don't think the FDA has removed the ban for ephedra.
