If someone driving in a "lifted" truck crashes into you and runs over the top of your car hurting you seriously, what are your rights? The truck may not have done this if the bumpers were at a normal level. Does the other driver have more responsibility now that he/she has modified the truck beyond that of how the truck was delivered from the manufacturer?

When I say "lifted", I mean 4 - 5 inches or greater and either a body lift or a chassis lift. These trucks would kill me immediately in my convertible, but I've always wondered how a case like this would look in court.

As long as the vehicle is lifted within the range of local laws, you'd have no more right than in any other accident.

And those aren't the only risks in driving a convertible. In some cases you are actually safer on a motorcycle. At least you have a helmet.

But I wouldn't worry about it. Just enjoy your vehicle.

Every state has different laws concerning what is and is not legal on trucks. Find out what your state's wheelbase and height limitations are and that will give you a better answer. Keep in mind that many of the guys that lift their trucks up to the limit and sometimes past know the law and will do things to get away with it. For example the maximim height in your state may be measured from the ground to the lowest part of the bumper to the ground. All you need is an extension hanging down from the bumper and you're good. Or your tires may not be able to stick out past the widest portion ot the vehicle body. Make some extended fender flares and you have beat that regulation too. It's just a slippery slope to be on, really.
To say that your vehicle wouldn't "win" in a collision between it and a big truck might be true and it may not be "fair" to you but at the same time it may not be illegal. Look at it this way, I'm sure you could T-bone a Vespa and that guy wouldn't have a chance. But you are not illegal, just in a safer vehicle for a collision of that certain type.

If the truck was within legal limits, then the liability is the same as a similar accident with a non-lifted truck.

if the truck was legal and had a current inspection sticker the liability would be the same as a regular vehicle.

What difference would it make? Hopefully there was car insurance. If it was insured doesn't matter what the vehicle is.
