he can probably get a public defender to help him and since he is in prison it can be done for free or even legal aid might be able to help him

You know, I always wondered how people find success with women. I am smart, I think I'm good looking, nice guy, nice career, funny, etc. I had a hard time finding any women (although I eventually found my wife, but before her it was hell).
Yet there are some people who have many women in spite of not having any of the things that women allegedly look for.
I just don't get it. Please smarten up. Go back and read your question - you want to make a married man who's in prison get divorced so you can marry him.
His wife would probably love your help so he can be rid of the loser.

why would u want to marry someone in prison and to add more he's already married. No sense at all. If he wanted a divorce he could of had it done already. When someone is locked up divorce can go fast. He's playing you and he's never leaving his wife. You can do better. Look for someone whos not in prison.

WOW! First you need to re-group and decide if you really want to marry him! You need to evaluate a lot of things: how long will he be in prison? what is he even in prison for? why isn't he divorced? why does he want to marry you now?
If you still feel you need/want to marry this man, then the only thing he can do is file or have his wife file for a divorce petition through his attorney (I am sure he had one when he went to court) after that, I am not sure how it works for the two of you to be married...if the prison system he is in allows it, you can do it there otherwise you may have to have a proxy marriage. Inmates often offer to marry people to have a place to go when they get out. Then, they take your money and dump you.This is a married man. He is a criminal. He is in prison. Geeez. Find a good guy who has never commited a crime and have some respect for yourself. You can do better. (By the way, he has an attorney. He can get a divorce like anyone else if he wants to. He probably doesn't want to.)

He can still file for devorice even if he's in prison. My fiance is lockup to.So I kinda know what you are going throug.But what I would do is wait until he's out.To make sure that he really wants you.So many guys will say enything to a girl cause they are lockup.Just wait until he gets out in try to stay ingage for at less 3 months after just to see if it's real dont want to see you get hurt. The dude is 1, Married 2. A felon ( misdemeanors don't do state time here) 3. not going to find work any time soon 4. Not able to sign many leases and did I say MARRIED.
What is it that makes you want to wait for this guy?

Why would you even want to marry him. The fact that he is already married and in prison are two RED Flags as to why any relationship with him is doomed to failure

News flash, He isn't your fiance' he is someones husband and married to her. Why 1.) would you want to marry someone who is a convict. 2.) why get involved with a married man.
3.) He is playing you and his wife both, I would bet money on this.

First, you go to a shrink and explain the problem to her. She will then have you institutionalized for thinking you can marry a married man. Second, she will prescribe shock therapy until you no longer consider marrying a man who is in prison.
