Initially it is not the teacher's responsability to place the child in special ed. They recommend that the child needs additional support that cannot be provided by the teacher without disrupting the classroom. Then the school's special ed department will jump in and investigate. After all that is done they should meet with the parent and discuss their recommendations. You then can agree or disagree. If you disagree it then gets complicated.

Unfortunately teachers are quick to label children just because they are teachers. As a concerned parent before your child gets labeled as a Special Ed student something that will stay with this child forever. Your child needs to be pretested, tested, evaluated, and re-evaluated by Psychology experts and trained Specialists, don't fall for some untrained professional teacher to diagnose your child improperly.

well typically the children are individually screened by a licensed psychologist using standardized testing. Mistakes do happen I'm sure, but the instructor is trained in teaching these children and a mistake will probably be spotted quickly.

I think if they do not have age-appropriate skills (such as being able to form sentences), they probably need some sort of help.
