We get invited to my sons friends mom's birthday party by her husband. He was my sons football coach. We have lived in this subdivision for 7 months now, so kind of getting to know everyone now. I decide not to go, so my wife and son go and during the birthday, the kids start thinking of getting cake on her face, and the husband says, "yea do it". My son is standing next to one of the kids which has cake and my son hits his hand and the kid continues to put cake on her face (birthday lady).

The lady absolutely flips out and proceeds to continously slap my son including scratching his face screaming for him to get out and never come back. My son just looked at her while she continued to slap and scratch him. He then left and came home with scratches on his face. Should I sue....? BTW, I don't need any money so it's not one of those cases. BTW 2, No appology in the past 3 days. Should I sue....?

Sue for what? Your son was wrong to "cake" someone, especially by forcing someone else's hand...be "man" enough to do it himself.

The woman over-reacted to the situation. That husband encouraged it is no defense; what he advocated was abusive in my opinion and simply used his players as a tool to degrade a woman for her birthday.

You are owed an apology from the husband as the instigator. On the other hand, it seems apparent the family is pretty messed up. Plus, how was your child financially harmed? "Pain and suffering?"

I'd move on.

No. Don't sue. Apologize.

Here's my reasoning:

I don't know how old your son is, but I am betting over 7 if he plays football. He "assaulted" her first, if you want to use that term. If she flipped out, she did it while defending herself.

He is old enough to know he should have stopped when she got upset, and he should have apologized profusely.

She probably over-reacted because she thought that it was your son's idea to cake her. (She singled him out?) Coach's wives often do a great deal for the team that goes unnoticed. She may have been insulted and felt hurt that a kid she sees herself as helping did something disrespectful to her at her party.

So, no, I would not sue. Your son was invited to a party where (encouraged or not) he did something offensive (and some would argue physically abusive) to the guest of honor.

You should approach her and talk to her. Explain the whole thing.
Make amends.

I understand that you are outraged over your son being slapped and scratched. But a lawsuit will not solve anything and could lead to counter-suits against your son, especially if he is much older than 7, and hard feelings.

And what was your wife doing during this attack? She was there to supervise and protect your son.

No, you shouldn't sue. But I would let everyone know about this behavior and lack of apology, and make sure the football team's parents are aware they should not go near this woman.

I think she should be charged with assult. Your story does not give the age of your son nor is it clear as to if your son did anything to her. It was all in fun and this woman overreacted and should be ashamed of herself especially as she did not appologize.

go to her and and demand her tell the kid she is sorry and (get her side of the sorry frist) if not just stay away for that family. ( i don't think you can win if you sue becase of the other kids at the party could have did it. and she could lie about it to the Jury or how ever(

She shouldn't be laying her hands on your kin in the first place, but she completely flipped out like a wild beast. At least press charges for assault.
