I am a full time college student with a part time job. I can't afford an attorney to even get visitation of my three year old son. I am not an unfit parent. I got in trouble and was sent to prison for OWI when I was 22yo. I am now 24. My aunt has my son and the agreement was that I would get him back when I was back on my feet. The closer I got the less she allowed me to see him. She is having problems with having children and just had another miscairrage of twins and I feel that her situation has a lot to do with her not wanting to let go of my son. She is my family and I don't want to hurt her but she is not worried about what this is doing to my son. He has got to be very confused and he is only 3yo. Any advice would be great. Thanks.

I don't think that going to court is good for you. She is going to be able to present you as unfit. You should try to work things out with her. Maybe see if you can move in (if she lives by your school) and let her feel like she is taking care of "her kids". She's having problems having children and she probably can't understand why you are not treating yours well. Taking this issue to court will only push the family farther apart.

You should go to court and ask for your son back. Your parental rights have not been terminated and courts like to see the parents taking a role in the raising of their own kids. Not mind you, you have every right to visit your kid and your aunt cannot stop you.

The only way the court will not let you have the kid back is that you don't have a mean of supporting your kid.
