I sold some items on Ebay (and I'm new to it) and I still have someone who hasn't paid or contacted me. The auction ended 9 days ago and I have sent them one e-mail asking them to please pay through paypal or contact me if they will be paying with a check or money order. In my instructions I tell them they must contact me within 3 days and pay by 10 days after auction close. Should I start an unpaid items claim tomorrow or send them another e-mail? If I send them another e-mail, do I warn them this time that I'm going to take action if they don't respond?

I would sent them one more e-mail say like this is a final notice and if you do not respond. Give them 24hrs and if they do not respond to start the unpaid items claim or see if the next highest bidder is still interested.

Heck I had someone start an unpaid items claim on me before the auction even expired. Yes that is what I would do.

You have given them plenty of warning. I would say furthur warning is unneccessary.

Follow the ebay buyers and sellers guidelines to the "T". You are not the first who has had this problem with buyers who fail to pay or communicate. I would read the regulations and policies and then contact ebay, not the buyer. This person has already failed to follow the rules that you laid out. No matter what, YOU are protected. The buyer is at fault, not you. Contact ebay for all your ebay questions. Good luck.

Send another email warning them. If they still don't pay within the requested amount of time, go ahead and give them bad feedback and file a complaint.
