I am delighted to tell you that you cannot sue Santa,the love conferred on Santa by the children of the world grants him immunity from prosecution by any individual ,government ,or state,he is free to enter such normally sacrosanct buildings as Buckingham Palace,The White House ,(although it was rumored that Mr.Bush tried to prevent him until Jack Frost threatened to turn Washington into another North Pole if he did so ) and the Kremlin,and finally just think what would happen to your good self if you tried ,children by the thousands camped outside your door howling for your blood, the tabloid newspapers" who known a good story "vilifying you in every edition ,your friends and neighbors ostracizing you ,would it be worth it ?

Santa Claus has a long-recognized privilege of entry, and therefore commits no tortious act by sliding down your chimney unless you have clearly posted a sign.
What you might want to do is clearly put Santa on notice that failure to meet your Christmas wish list will put you at risk of severe emotional distress.
On Christmas Evem you should post signs saying "SANTA KEEP OUT UNLESS YOU ARE BRINGING ME A RED RYDER BB GUN AND INGRID THE INFLATABLE SWEDISH COMPANION."
If he doesn't come through, bring actions for intentional infliction of emotional distress and trespassing.

Absolutely. If he doesn't deliver on the goods, call an attorney. Be prepared to lose the case though. Santa will try to prove that he couldn't fit down your chimney. His lawyer will say, "If the butt don't fit, you must acquit."
