In Texas, a seatbelt citation is a ticket-only offense under normal condtions.

However, in Atwater vs. Lago Vista, the Supreme Court ruled that arrests can be made for traffic offenses and the person can be held until the fine is paid, or a bond is set by a magistrate.

No jail time, only a ticket...... you really should wear a seatbelt though, it saves lives.

Just imagine going down the highway, not wearing your seatbelt and hitting another car head on, don't take any chances, wear that belt!!!!!

As far as I know there isn't a state that will put you in jail for not wearing a seat belt. Most states just give you a citation for not wearing a seat belt. NOW, should you fail to pay the fine or go to court to contest it and they issue a bench warrant, then YOU can bet YOU'LL go to jail.

I have never been at war with my seatbelt, but I am sure it is a misdemeanor offense with a stiff fine attached. CLICK IT OR TICKET!
