He is trying to say that because it is a shared fence that he should not have to pay for the entire cost of the vet bills for my rabbit since it was more the the original estimate. I say if his dog had not broke throught the fence in the first place this would not be an issue. If anyone has information on this type of legal matter I would appreciate hearing from you.

Yeah is liable..but dont sue them its not his fault...if they are good neighbors they will offer to pay for the fence..dogs naturally are going to look for animals like rabbits..its instinct!!! put the rabbit to sleep if anything..people eat rabbits everday! go to pet supermarket and buy a new one... and you should have your rabbit in your backyard!!! you should have it in a cage...the rabbit could have harmed itself...who cares if you have to pay stop crying! the fence is probally only made out of one plank of wood..i dont think that the dog tore the whole thing down...it will probally be pocket change to fix

Yes, is liable for ALL vet costs because it took place on your property. And if its a shared fence he still has to pay for it because the dog technically got out of his fence and attacked your rabbit, and he should have to pay for the repair of the fence too. Just tell him he needs to pay it or you'll get a lawyer. Thats the last thing he wants is for the law to get involved. I had the same sorta thing happen only it was my neighbors dog and my dog and he payed for all the vets bills, he insisted it was his fault.

As a big fan of People's Court, you would definetly win in court...

HOWEVER!
If the fence was previously damaged (ex. a hole, broken, etc.), since it is a shared fence, it is not completely his fault.

BUT...
If the fence was in good condition, it doesn't matter whose it is. His dog broke it, and attacked your rabbit. Therefore, he is liable.

If you, or your rabbit had anything to do with the breaking of the fence, he is not responsible, but if it was his dog alone that broke it, he is.

Well...Thats kind of difficult. When I say that I mean like where was your rabbit? (Backyard? In front? Were you watching it what?) But no I think either way he should be liable. Shared fence or not! (Who doesn't have a shared fence?!? Thats a pathetic claim to not pay!)

The person who owns the dog is liable for 100% of everything, and if you want good tips in getting rid of the dog, let me know.

He is laible for the whole mess, for his dog broke through the fense.

But where to go to get info on this is a tough matter, without consulting a lawyer
