I ordered a laptop on eBay for 300.00. The auction did clearly state returns were accepted up to 7 days. I received the computer via UPS on 11/20. However did not open it until 12/10 to find the wrong computer. Granted, this is a more expensive computer with more ram, memory, programs etc. I emailed the seller. And he emailed back "You received the computer on 11/20. This was the start of your 7 day no questions ask refund period which ended 11/27. Something you agreed to when you placed your bid on this auction, a legally binding document. I would have been glad to have assisted you for a refund up until 11/27."

In aiddtion seller claims he sent an email offering this upgrade for no extra cost. I did find this email after looking back. Apprently I looked over it. It said something like "if I don't hear back from you within 48 hours I will assume you want this upgrade. Otherwise email back when you read this."

Yes this is fair, you should of opend it once you got it.

By bidding on Ebay you enter a legal binding contract with that seller. You agree on THEIR terms of sale, and returns. If the auction clearly states that returns are accepted for up to 7 days, and you waited over 2 weeks, then you are in the fault. There is nothing that you can do legally because the auction states the terms, and you agreed to them when you bid on that item.

The seller is not in the wrong, at least they emailed you back!

Is there anything wrong with the machine? Does it do what you want/need. If so the warranty will start when you take posession of the item but you seem to be infront with this so take it as a bonus.

All else fails, tell the seller you will leave -ve feedback that normally makes them al little more friendly

I'm not sure what you are complaining about if you got a working computer that is better than what you expected. If you really want to complain you can go through your ebay account and lodge a complaint with them. It may also be enough to threaten to do this or to leave negative feedback.

But seriously - what the hell is the problem? Seems to me that this situation is at least 75% your own fault.

So the computer you got is better then you expected it to be and you want to return it...?

Other then that you should have checked the day you got it for any problems

sadly yes it is fair....unless you have insurance....maybe talking to the guy and begging could help....other wise feel bad for u.. but wait a sec did you just say the computer you got was better then the one you ordered or did i read this wrong

It sounds to me like he is bending over backwards to please you and certainly correct that your return window had closed.

If he sent you a more expensive computer what is your gripe?
