what can my mum do as her landlord has served her with 30 days notice yesterday as he wants to sell the flat she is living in ?
she suffers from agrophobia and has panic attacks so she is not able to work, which means she has no money for a deposit or rent in advance to look for somewhere else,
she doesn't know if the council would help her and is worried if they do that they would only offer her bed and breakfast, but as she has agrophobia she wouldn't be able to go out in the daytime as some b&b's insist on,
any advice would be great as she is working herself up into a right state.

she can't move in with me as i have my 2 kids to look after, and where i am supposed to put her, as for how does she afford her own home i'm sorry to say she has to have housing benefit to help her. it's not something she is proud of buy she has to do it.
she has worked most of her life and she owned her own business with my dad for over 20 years,
but he then got a brain disease and couldn't work amymore so she had to look after him so the business fell apart.
the panic attacks started when she woke up and found him dead one morning . and to make matters worse the landlord is dad's brother !!!!

THE LANDLORD MUST GIVE AT LEAST 2 MONTHS NOTICE WHICH ENDS ON A RENT DUE DATE.
Make sure your Mum tells the landlord this immediately as this is law. See The Housing Act 1984 for details.
This will buy you some extra time. There is not much you can do about the eviction itself, however, as the Landlord is well within his rights to ask for the property back.
If your Mum cannot work then she will definately be able to get Housing Benefit from the council, the best thing to do is go and ask them. The Council will initially tell her to stay in the property. This is the best action to take beacuse if she just leaves when she is told then she will invalidate any claims for housing assistance, however, if she stays in the property, the Landlord will have to get a Possession Order through the court. This will not be detrimental to your mother as long as she pays rent for the time she is there. The benfit of this is that the Council will act very quickly if a possession order has been served.

Speak to age concern if your mum is old enough, I think the minimum age for ladies is 60 and they can give good advice.
Also speak to the citizens advice bureau who can help.
I am not sure, but if she has some kind of note from the doctor explaining about her agrophobia, the council may speed up her case.
If she does go to the council they may put her up in a bed and breakfast if the need is that urgent but it won't be forever and they will offer her a place as soon as one becomes available.
I hope her case is resolved soon.

You will need to register your Mum with local Housing Associations and the council. They may do a home visit. Be persistent. A very good place for advice is the charity SHELTER. You could email them on your Mum's behalf. They will respond within 3 days. Get cracking. Stop apologising for claiming Housing Benefit, this is what your parents paid tax for, for 20 years.Your Uncle kicking your Mum out could work in her favour by giving her priority. Good luck.

Firstly the "30 days notice" your mother has received is the first step in Possession Proceedings (eviction) and ought to state something to the effect of "Notice of Seeking Possession" at the beginning. Your mother does not need to move out within the time stated in the letter and the landlord cannot apply to the County Court for Possession until after the expiry of said notice. It is important that your mother remains until such time as proper Possession Proceedings have been taken by the landlord.
(NOTE: The above is on the assumption that your mother has a legal form of tenancy, usually known as an "Assured Shorthold Tenancy". It is vital that you check the type of agreement she has to ensure appropriate advice).
Given your mothers health needs, she may apply to her Local Authority to be rehoused, however, it is unlikely that alternative accommodation will be offered until such time as the court has issued an eviction warrant but get the ball rolling anyway.
Contact your local Citizens Advice Bureau/Law Centre as soon as possible for further advice and assistance.

Go to the Homeless unit at your local council and tell them the problem. They cannot leave you out in the street. Also talk to your doctor, MP, and your social services department. If your mom is disabled they cannot leave her homeless and she will be given priority too. If an Asylum Seeker can have help by the authorities for somewhere to live, then surely a Brit can have the same help.

Take it she has a 6 month assured tenancy agreement? First thing you need to do is register your mum as homeless, Is she registered with the council for a home.? You not your mum need to go down to council and do this. Take all social workers reports etc with you, Don't understand your comment about agoraphobia. read this http://www.geocities.com/cathyuk1967/ . u really need to get her doctor involved in all of this. he needs to explain to the housing association about your mother's needs and illnesses. the housing association will probably offer her B & B unless there is proven medical reasons not to. get her a doctor's appointment, and do this as soon as u can...... these things take time to sort out, and 30 days is not a long time. good luck. i hope u manage to sort something out.

She should be legible for a crisis loan or community care grant. Ask at a neighbour hood office or call them. They can help loan money to pay for deposits on flats and houses, especially for people like her, try it.
