Your brother can only get a divorce while he is deployed if he hires a divorce attorney. Someone must be present on his behalf during the procedure. He may even have to schedule a hearing during his R&R leave. But no it is not impossible, just going to be hard. Because he may not be able to prove his wife is cheating while he is in iraq so he will need a good lawyer to avoid paying alimony and such. Most people just tell their chain of command, and discontinue allotments, unless he has kids which makes it very incorrect and will hurt him during the procedure. Best advice do an internet search for a lawyer in his area and retain him, they can use the computer for the whole thing.

I know one thing while your brother is deployed his wife can not divorce him by law until he comes stateside. There is some kind of a law that he can not be served divorce papers while he is in Iraq. About your brother trying to divorce her from over there then thats a different story but I think its would be hard for him to even start the divorce papers while he is away.

I am not in the military but my husband is. Tell your brother he needs to tell his officers or some one whats going on and let them know that he wants a divorced. It might take a little bite longer then usually because of him over there fighting. He needs to speak with people who are in charge. Also he might want to switch things over to another family members name so that his wife does not have any rights to anything and nothing can happen to his stuff. Hope your brother comes back safe.

If his wife is cheating on him, than there are steps that he can take to walk away from her civilly. First of all, He needs to contact his Unit Commander and tell him what is happening. Second of all, They will inform the Military Police and conduct an investigation. Finally, He will be assigned a Judge Advocate that will review his case, and make a judgment. At least he will be able to walk away with his head held high. The military does not condone adulterous behavior. It is important to note: If he has substantial proof, he needs to keep it and make future recordings.

He needs to contact his base commander. It can be done, probably not too difficult if he initiates it. There would be problems if she tried divorcing him while he was deployed.
Here is the problem as I see it, and trust me babe, I am forever thankful to your brother for providing my freedom. The military are my heroes. The problem is that no one, not you or I, know why she is cheating.....her life has been hell if her husband has been gone, you don't honestly think that he hasn't cheated on her a bit while he has been deployed do you? We all have sexual needs, they are both in hell, but his is life threatened daily. When our life is in that kind of jeopardy the natural reaction to help maintain our humanity is love making, notice I did not say just sex. We make love to make us human again, to remember or bring about tenderness when we are feeling less than human. Have you ever noticed how common is to make love as soon as someone close to you dies, it makes us feel our humanity again.
So if this is something she has always done, so be it, let him file and get it over with. But if its not, be careful how you judge either of them. They are both in hell and are both human. They likely need support and understanding.

#2 cut the allotments NOW!!
#3 terminate any and all powers of attorney
#4 start researching child support, many states will hold him responsible even with a dna test.
#5 FIND A LAWYER THAT SPECIALIZES IN FAMILY LAW. i can not yell that loud enough.
that was the only thing that saved me during my divorce

First of all, Does your brother know your wife is cheating on him??? If so, who told him? Does he have proof of the affair?
If he has proof of the affair, and it is not just second hand gossip, than he can file for divorce. He can do this through his Chaplin. He will give him advice on how to proceed.

It is possible. My brother was in Iraq for a year, lived in NY. He appointed my father as his power of attorney and my father handled everything.
