My father passed on in May of 2005 with an estate over 2 million. At the time of his death, he wa involved in a lawsuit from my brother-in-law over a house that my mother left him in the will. My mother died in sep of 2003. She left the house to my sister and brother -in-law, but my father had a "life estate" to stay there. In other words, when he died the house would go to them. Well, they sued my father to pay the taxes on the home, and his attorney took over 300k from my dad, and still the case goes on, even thouhg my father is deceased. My father's money is being sucked away y bogus attorney fees. How can i get it investigated and have them disbarred? The attorney is in California and i live in maryland, so its not like i can walk in his office.

You need an attorney that specializes in Wills, Trusts and Estates.

The attorney is all the way across the country right? Then how do you know what he is doing? How do you know that there are "bogus attorney fees"? You are opening yourself up to a lawsuit if you keep up these accusations. Just because you aren't getting the desired results from an attorney doesn't mean he is ripping you off. Besides, your father was living in the house, he SHOULD have been paying the taxes.

First of all, your father was not obligated to pay taxes with only a "life estate" in a will of your Mom, unless it explicity stated he would pay taxes(doubtfull); the full title holder - the sister & brother-in-law are obligated from Mom's death in 2003 to pay taxes. Second, where is your Dad's money now? Who was it left to in his will - that should control, that person can protect their own money. Don't even bother trying to dis-bar attorneys in this case, the Calif Bar Association or court action would be futile, save your time and money. Your time is better spent on helping to protect the rest of the estate money, where ever it is.

File a complaint with the California Bar Association and get a Judge to issue a restraining order forbidding that crooked attorney from taking any more money until the matter is settled. I hate lawyers.

Convert all of your immediate assets to currency. Put them into a safety deposit box; only you can access a safety deposit box. Do NOT pay anybody anything. Get a gun for self defense and move off the grid. When you feel safe, make a plan and contact people. Make sure you are more aware of the situation and that you are running the show.
Don't listen to people who apply laws to lawlessness. Respect authority.

you would first, have to say who the executor of your father's will is, and then hire an attorney to contest that person as the executor, whether it is the sister or the attorney or what. i cannot tell from the story you are telling. you need to talk to a CA probate att'y
