I have a 2 year old son who's father never established paternity. I want to leave the state. Can I do so without informing him, and how do I keep him from coming back 10 years from now? I want no child support, I just want him to have no contact. Also there is a criminal no contact order thorugh the city that I live hime because of domestic violence and there is an extended order for protection against domestic violence. He has spent approx 300 days in jail for domestic violence on 2 seperate occasions.

He is not on the birth certificate. He never signed the papers to be on there.

He has never denied that he is the father. He is abusive and I don't want him to be a part of my sons life. He has been in jail so much that my son does not even know who he is.

your protected by the state that you live in by a no contact order which more than likely covers your child which also means that he cannot come near you.. if you leave the state take the no contact order with you and get it transferred to the new state.. then get an attorney to file paperwork to disolve all his parental rights (if he's on the birth certificate) if not then leave the state keep the no contact order until it expires and if you still fear for your life or the saftey of you and your child get a restraining order.. and if you're still worried contact your local prosecutor they can give you more advice on how to leave the state and keep him outo f your life ( or if you filed the domestic charges you should have a victims advocate you can speak to)

Is he listed as the father on the birth certificate? If the answer is yes then call a lawyer...you are doing the right thing...good luck and stay safe

I would just leave state and not tell him where you are going.your son don't need to be around that violence.take him where you both will be safe and away from the abuse.make a better life 4 u both.I wouldn't worry about 10 yrs from now, by that time he should of moved on with his life also.

Yes, without him establishing paternity, then he legally has no rights to your child. Given his past history, leave as soon as you can....you don't owe this guy anything. Guard your forwarding address, and be careful of who you tell where you're going. Best of luck to you......you deserve so much more than what you've been through.

leave the state he isn't listed on the child's birth certificate, so he has no rights.

That's a tough question. Well since he does not admit fathering your child you can just tell him directly it is not his so that he will stop bothering you.if he believes you then he will stop seeing you and the kid.

then take it to the courts show them this and you should have no problem leaving the state.
