Received hand written bill of sale for a loader truck. Price of truck was $40,000.00, "as is". Seller of truck made out the bill of sale and signed it, however, my husband's signature is not on the document. I have requested but have never received a title. The truck in question, turned over on my husband, resulting in his death, and the truck was insured by the seller at the time of the accident. Need help determing ownership of this truck.

Unless title exchanged hands, the other guy still owns the truck. As far as for the liability aspect, you have to talk to a lawyer.

The specific regulations may vary depending on where you are, especially for motor vehicles, but in most places a hand written bill of sale is valid. It should indicate the following: * Seller name, address, & phone * Buyer name, address, & phone * Complete description of the vehicle including make, model, color, VIN, mileage, and any special features * Previous registration (i.e. license plate) number * If known, new registration number * Date (and probably location) of sale, and amount paid. Some office supply stores sell general forms for bill of sale; haven't seen one made for vehicles but it might exist. In CT at least, your motor vehicle registration form contains a space on the back to record the sale or transfer of the vehicle.

Vehicle title registration controls who owns it. Libability is in the registered owner, otherwise any drunk driver could write out a quick bill of sale to Joe Blow to get out of being liable - aint going to fly! Almost every state requires that the seller turn in a notice of sale of vehicle to the DMV within 10 days or so after sale, in order to avoid owner liability; if seller did not, then he is still the legal owner in the eyes of the law.

lots of people handwrite those things. make sure it is signed and the items described on it that were sold to you. it will also be nice if the company name is on it.

but it is legal.
