My husbands daughter is a terror. After I had my first child she turned nastier than nasty, I even think she tried to smother the baby once, but I could never b sure. We sent he to go live with his sister in NY, she stayed there for a year terrorizing thier family & then took off to California to see her step sister who is a pill herself. Her sister has always been telling her to come live with her in CA & we've all been trying to not let that happen, but you all know how strong wills can be. After she got there they convinced everyone that they would b just fine. And everyone else agreed fine let them terrorize eachother instead of everyone else. Now 6 months later the step sister wants child support for the daughter who is only 17, She doesn't have any history with the law, she's justa home wrecker. Anybody have any advice as to what to do now. My husband thinks he can legally disown her. is that possible. She's been going her own way for over 2 years now. What do we do now

What horrible people you are.

Don't you know that if a child is "acting out" in such a way it's because of a void inside that they need an adult to help them with?? She's probably severely emotionally bruised and needs the support of two loving adults and she's been handed a wicked step mother and a spineless dad.

You still have to support the girl financially, whether you like her or not. My suggestion would be to work out some differences so you don't feel like it's money wasted.

Legally disowning a child does nto absolve you from the obligation to pay the child support. As for paying the sister Child Support, that is something you will have to contact a lawyer about. If you truly want this "terror" out of your life, paying a lawyer shouldn't be an issue.

You could ask the court for an emancipation order that would free your husband from support if they agree, if they don't he would have to pay till shes 18 but I think you have a good case since shes been gone for 2 years and never asked for it before. Calla family law attorney.

With so much hatred radiating off of you towards her, how could she be anything but nasty back? Whoever her legal guardian is should have custody of her. If her sister is not her legal guardian, she can petition the courts for custody, and if she's had her for 2 years, there's a good chance she'll win. If she wins custody, the court could order child support until she turns 18, or graduates highschool (before age 19.5), whichever happens last. She could also possibly collect $$$ from the state as a foster parent. If she does NOT win custody, then you & your husband will probably be liable for taking her back into your household.

wow, well, first of all , yes, he has a responsibility to financially support her, until she is 18, and longer if she is in school/college,,, and that is something he should of been doing all along,,,,,,,

with that said, where is her mother in all this? she sounds like a very troubled child who needs both parents,,,,, she most likely has acted out in response to alot going on in her life, i dont know what age she was when you became her stepmother,,,,,, but that would be significant also,,,, if she was a child or early teen, she would of needed alot of help adjusting,,,,,, calling her things like nasty, a terror, and a home wrecker really trouble me,,,,,,,, and yes, i have been a stepmother and had a baby and a teenager from my husbands first marriage,,, it takes alot of work to make it work for everyone ,,, no he shouldnt disown her, she , for better or worse, is his child,,,,,,,,

Yes he will have to pay child support until she is 18 UNLESS She has herself declared an emancipated minor and the courts allow her to live on her own To do this she would have to prove to the Court that she can support herself

well if the little terror is only 17..... i dont see the step sister getting the child support.. by the time the court actually grants it the girl will be 18.

He could give up the rights, but that would be something that he would have to take up with a lawyer, but until then he is obligated to her until she reaches 18, or until she is out of college

I don't know if a parent can seek emancipation for their children, but it might be possible. Given her history as a runaway it just might be possible to make her an emancipated ward of the state.

Unless she is emancipated, he has a duty of support until she reaches the age of majority!
