If a pecuniary legacy is made to a son under a will, but the son predeceases the testator, and the son has a 16 year child to which the legacy passes to - how will the gift pass to the child, i.e. under trust or they simply cannot receive it until they are 18?

It should pass under the trust.

Essentially a Gift will be held on trust until the son is 18, where he gain fully entitlement. A will is drafted to cover such situations.
