There's no easy answer.
If you're in a GLBT friendly place, it might be good form to ask the management. Not only are you making sure they're not going to throw a fit about you being in the "wrong" room, but you're also showing respect to them which will hopefully be returned in kind.
But when you're not in a GLBT business or gathering place, who knows? Some cities have laws about this, and some businesses have policies of their own in place. Some places base the decision on your overall gender presentation. Others say the "plumbing" (of the bathroom) must match the plumbing (of the person). In other words, if you're not post-op and you don't have your papers you're stuck using the men's room.
As you can see from the responses here, people on both ends of the gender spectrum are extremely squeamish about having someone transgender in their washroom. Things could turn vicious or even violent. In these situations, don't try to argue about your right to be there or stand up for yourself -- GET OUT. They may brag to their friends about their small-minded "victory" over a "******", and that may cheese you off, but at least you're not in the hospital or worse.
The Transgender Law Center has a publication called "Peeing in Peace", which you can download as a 48 page PDF @ http://www.transgenderlawcenter.org/pdf/PIP%20Resource%20Guide.pdf
They probably give better advice than I can.
I don't know why bathrooms are such an issue for trans people. Actually, scratch that...I do understand. But I wish we all could get over this infantile thing we have about the place we go "pee pee" and "poopie".

In most states, there is no law dictating which room to use. With that said, if you are dressed enfemme, use the ladies room. But be quick about it. Don't talk to anyone, don't fix your makeup, do you business (sitting down), wash for hands and get out.
Although it might not be illegal, someone can make a complaint about lewdness even though you are behind a stall door.

Depends on what you are wearing. If you are in drag (crossed) then use the ladies but sit down in the cubicle. Some ladies might object but it would be less dangerous than using the mens (men are a bit reactive to that sort of thing - women are more understanding).

If it's CLOTHING that is different, you use the bathroom for your gender. You are a male? Use the men's room.

You are a man so you use the male bathrooms, I don't think girls would appreciate a man in their bathroom.

It would be proper for you to use the ladies, but I don't think the men would care.
