Simple solution :
- restart your machine
- copy any file to a temporary folder
- delete that file
Your Recycle Bin will now show as empty.

If this is the only file that the recycle bin is unable to delete, then, restore the file from te recycle bin to its original folder and boot your system to the DOS prompt and delete the file. In case the recycle bin is unable to delete any file in it, then install or reinstall (in case it is already installed) the latest service pack of the Operating System, reboot your PC and the recycle bin will start working.

You may have a corrupted icon cache. Try this first: Start, Control panel, Appearance&Themes, Display and on the General Tab select the Empty Recyble bin and click Restore Defaults. If that doe not work, you need to clear the icon cache. To clear the icons cache make sure you can view hidden files and then open your Windows directory in Explorer and delete the file called "ShellIconCache".
When you restart Windows the icon cache file will be automatically recreated.

First insure here is not application is running in background named this.. Open TaskManager (C+A+Del) then kill process if it has any process related to this..
II>> Go to ur Drive and click Folder>>Option>>Show Hidden files and Folders && Hide protected Operating system files uncheck both box.. click ok and ok
Now u will see recycle bin in drive open its folder and remove the file from it.
Rollback the process of Hidden files.

Double Click recycle bin, hit empty recycle bin.
If its a program you might need to go to your program list and unstall the program off your computer.
