Are you trying to avoid used phone sellers? Because then you are mostly out of luck. Cell phone companies don't normally sell direct to the consumer, they work through the cell carriers. And of course the cell carriers will only sell you a phone with their service and a contract. That's why all the good answers here point you to sources of used phones.
Other options:
You could buy a Treo from Palm.com, since they DO sell straight to the consumer. Be prepared to spend up to $500.
You can buy a Tracfone for a mere $20, and pay someone to SIM unlock it, and then use it on Cingular. See more here http://news.techdirt.com/news/wireless/article/6833
But really, your best choice is the one you eliminated in your question...ebay.

I live in Finland and you can buy singular cell phone without plans at any department stores, such as Stockmann, Sokos or even at the cell phone plan-company. The won't force you to take any plans, you can choose it yourself ! A single cell phone goes for 200euro minimum.
