All family law is for the most part State law not Federal Law. You would have to check with your state and see what laws there are regarding terminating the legal relationship with your husband.
States usually do not like annulments. They for the most part no longer exist. States do issue annulments if the marriage is 60 days or less in many states. But annulments basically are a thing of yesteryear's gone by. Third world countries are still very big on annulments. An annulment means that the state will make the marriage as if it never took place or never happened. No financial responsibility from him to you or vice-versa. The children may be another issue regarding subsidies for them. The court system, attorney's, and the legal world, that make their huge living off of divorces hate annulments. Annulments mean less litigation in the courts and less use of attorney's thus, less bread and butter for them. That is why the state lobbyists pushed to get rid of annulments in our country decades ago.
Look up your county court system on line (name of your county)____ superior court .com. There it will tell you what the laws are regarding annulment in your state. You probably will need a divorce. How I wish annulments still existed

Sounds like you have grounds for divorce, not sure about annulment( unless you are a Kennedy then you should have no problem getting an annulment, no matter what) Ha Ha...Anyway talk to an attorney, but do not remarry until you you have ended
present marriage.

When you say "us" I assume you have children. Missing for 13 years is probably grounds in every State for divorce. Called abandonment. So get divorced. Don't run out and get married before you get divorced. Double marriage is called bigamy. Interesting, it's all right to live with two guys but if you're married to two at the same time it's against the law. So, get your divorce, sounds like you have the grounds. And then get married.

They rarely grant annulments nowadays and its supposed to be that the marriage was done under false pretenses, hes gay, the priest was a fake, the papers were done incorrectly, there was fraud involved, not becuase he left and after 13 years youre finally getting off your butt to do something about it.

They will ask you for info and you can tell your situation after that lawyers in your area will let you know if they can help you and how much it will cost.
