I own a small fast food restaurant. I was in the back and saw a kid reaching behind the counter to grab a bag of chips. I immediatly went uot and they of course immediatly left. (with out the merchandise) What I wanted to know, is what I can Legally do when some one shoplifts. Detain them? File Charges? Ask for restituion above the price of merchandise even if I recovered it?

Also, I would like to know how to beat their *** without getting caught.

In Michigan you as a shopowner or one of your agents may detaine a suspected shoplifter IF you have probable cause and are not unreasonable in your dentention, I.e. you assult them or detain them for an unreasonable amount of time. Be aware though that if you go too far or if your detainment is unreasonable you may be liable for false imprisionment.

If you are going to beat their arses, make sure the video is off & you have some marks from a scuffle on yourself.

Obviously a poor joke. I was a convenience store clerk in Florida for years. I could call the cops,&, if they got there in time, have them arrested.. You can detain them, which could turn out to be ugly for you if one pulls a weapon. You can (here) make out a trespass warrant that prohibits them from the premises in the future.

Getting pretty cold up there, isn't it;? I'm originally from Adrian area.

You can only press charges if :

1. The person is actually observed taking the item.
2. The person actually leaves the store location with the item (steps over the threshold of the store) and this is observed as well.

Up until then, they have considered to still have the option of paying for the item.

How do you know his INTENT was theft. If anybody detained me unlawfully I would file a civil action against the person and a criminal charge of assult ( if the person layed a hand on me ) then I would sue the business.

You can detain them and call the cops. After that it is up to the judicial system to deal with them.
