It does say it's a repair and refurbish company so most of their products probably are, but it says the phone is brand new and never opened. If it isn't, contact Ebay's disupute and resolution center.
The seller does have a high ranking, so the phone is most likely going to be as advertised.

you can get a flip phone for 9.95 thats better than that phone. I bought that phone when it first came out what id say almost 4 yrs ago and it was a peice of crap and I paid over 200.00 for it with contract. good luck, sometimes cheap isnt always the best way to go

well hard to say,but its not like you have to buy it.Even if you did win the bid( yeah it wouldnt be nice).But trust me you wouldnt be the first person not to buy,the item that you won.
What are they going to do, come hunt you down...If you dont have a good feeling about it dont waste your money.
