with double pneumonia.He was not going to make it thru the night.my mother-his wife of 58 years is beside herself. meanwhile my sister who is the head intake nurse for the elderly at the same hospital calls her husband ,my brother in law of 30 years-an attorney lisc. in ill and head of the european divison of military intellegence, this man shows up alone with my sister and has my father and mother sign a will and an irrevocable special needs trust that allows him to be the executor,trustee,witness,notary,attorney AND the assesors office says owner-of my parents house --who can sell my parents home out from under them..IS THIS LEGAL AND WHAT CAN I DO TO PROTECT MY MOTHER AND FATHER.I SPENT THE NIGHT ALONE WITH MY FATHER THAT NIGHT TAKING CARE OF HIM.....THAT NIGHT WAS CRITICAL IN MORE WAS THAN 1 AND GOD BLESS HIM HE IS HERE TODAY ONLY TO FIND OUT HIS SON IN LAW AND DAUGHTER BETRAYED HIIM AND HIS WIFE...... HEELLLPPPP

Two defenses to a will or trust are (a) undue influence and (b) lack of capacity. Under the circumstances you described, the probate court could well believe that Dad lacked capacity and that your sister and brother-in-law exercised undue influence. Is the will still being probated? The clock may already have run on your being able to challenge the validity of the death bed documents.

Yoiu need to get a good attorney in that deals with probate issue and real estate, is sounds as if what they did was done when someone was not in their right mind and they preyed up that fact, and is should be able to be overturned
