i am taking my x to court for back child support, he was told if he didnt work he would not have to pay anything, we made and oral contract last aug, he paid thru dec.2005 and quit, is that a legal contract if i had a witness, in 6 years he has paid 850.00 dollars do i stand a chance, i go to court monday and really need some advice if it is worth it or not, we go to court in jan for a court order for child support, his lawyer informed him that if he dont work then he dosen,t pay is that true

He MUST pay child support to the State, not to you. The law requires him to pay if he is the father, no contract - oral or written, can relieve him of his duty to pay child support, otherwise every dead beat father would threaten or beatup his x into signing a release contract, it just won't happen. There is minimum he must pay even if he's not working, pay from unemployment, or he must sell off assets, etc., or go to jail.

Depends on which state you are in.
Try looking up information on imputing income--meaning even if you don't work, you could, and the court should attribute a monthly amount that you could be making in determining child support.
