I worked for 20 hours and did not recieve my paycheck. I work at a small buisness. When I was first hired there were no negotiations made about when or how I would get paid. Later my boss mentiond to fill out a time card and I would get paid every friday. I have forgotten to fill out a time card before--as I get so consumed with work--but the old bookeeper would pay me just the same. I always work the same days. And since there are only two employees, whenever the other one does not work, I HAVE to work those hours.
Well, without my knowledge the boss fired the old bookeeper, and I accidently forgot to fill out my timecard again. My boss did the paychecks on friday, and I did not get my paycheck as per normal when I walked into work on Saturday morning.
I called the other girl who works here to see where my paycheck was, and she said rather rudely, "you did not fill out a time card". Since she was here in the same room when the boss was doing the paychecks, that means that the....

...boss knowingly did not give me my paycheck just because I did not fill out my time card. Knowing the attitude of my rude boss it would have been to "teach me a lesson".

I do realize that I am at fault for not filling out my timecard. But is he at fault also for knowingly not giving me my check. It would have taken an extra 10 seconds just to figure out...oh, she always works 20hrs each week.

Is this a leagle situation? And if this isn't, what should I do?

They have to pay you - but you have to complete the paperwork.

Fill out the timecard and turn it in. They should then pay you the money on the next pay cycle.

If they don't talk to the labor department for your state. You will get paid.

No matter what, the boss still owes you the money. Fill out a late time card for each week if you haven't already. If he won't take the time cards, give him time anyway in a letter - then he has receipt of your time (keep a copy). If he still doesn't pay you, go to the State Labor Board and report him - he may fire you but then put wrongful termination in a small claims suit against him (usually up to about $7,500 depending on the state). If you have done any kind of work on the property - cleanup, painting, repairs, snowshoveling, etc., in the last 90 days or less, you can file a Lien against the property (costs about $15 to file a lien!) that will get his attention! And get you paid!

How many times did you forget to fill out the time card? I'd forget to pick up my paycheck sometimes, but I'd never forget to fill out something that would get me the check in the first place. Apparently, it was YOUR responsibility to fill out the card that they use to make out the paychecks--twice. Maybe they're trying to teach you a lesson, which it seems you've learned. I can't imagine a lawyer taking the case, but you can try.

Can you just fill in a time card for last week & hand it to your boss on Monday, along with an apology for being so late to turn it in? It lets him know YOU KNOW the rules, and you know you're due a paycheck.

Wouldn't that fix things?
