My ex divorced me 6 yrs ago and failed to put anything in the divorce decree for child support.I'm disabled and my ex gets over $700.00/month from the federal government for my daughter who lives with her. I was paying additional monies to the ex and my financial situation changed drastically the last 3 months.I told my ex I was going to stop sending my monies because the government was sending so much for my daughters support. She will get this money till she is 18 and also till she finishes college.She is 16 now. Can my ex take me to court for more of the same monies I have been sending for the last 6 years? I figure my ex as received over $60,000.00 for my duaghter over the last 6 yrs.

There has to be a court order for child support. If there is no court order than she can take you to court and get one but if you have little income there isnt much reason to worry as your child support amount is based on what your income is. You should try to do as much as possible for the child though.

It depends on what state your in. The laws are different. I don't think she can sue you for back child support if the decree did not order you to pay C.S.. But she can file a motion to modify the decree and its likley you would be ordered to pay c s until she is 18 or what ever the law is there.

and you and that lawyer need to talk.

the USA is crazy. I'm sorry to say it, I am no traitor or nothing, but my mom really paid a lot for me and my little sister on her own. So I hate it when there are mothers who are just taking money to just be taking it, not necessarily that which what they need to take care of their child.
I don't like it when a mom usses child support money to take advantage of people, not to support their child.
It's probably more than what the family needs, I mean, if she's working and everything, and I assume she is.

I don't exactly know your situation, but, obtain all your records of what you paid, and hire a lawyer.
In fact, don't even wait for her to sue *you*. Hire the lawyer now.

Yep. She can go to court to ask for a child support order or change a child support order any time she wants until your daughter is 18. That doesn't mean she'll get it, but you have to go to court and deal with it.

If there is a court order that you are supposed to pay child support he certainly can. It doesn't matter what other monies he or her recieve you were given a court order.
