That's a tough one because if we did repay and eye for an eye or tooth for a tooth so to speak, I think we would see alot less crime and violence instead of putting them up in prisons where they are taken care of and get paid college and activities and medical benefits better than we have. But we can't just cut off someone's arm if they steal or cut off their, you know what, if they raped. So I guess we have no choice but to continue as we are.

Punishment should fit the crime. To punish intentions is unconstitutional. Unfortunately, we sometimes punish intentions. It's called a "hate crime". Hate crime legislation proposes the idea that murder is more henious depending on the race, gender or creed of the victim. It must follow therefore that some citizens lives are worth more than others, which is a clear violation of the Constitution. (Ammendment 14).

Whatever the intentions, punishment doesn't work. If it did work, there would be fewer people going back to prison.
So, as a practical matter, the consequence of crime should be effort to rehabilitate the criminal. Everything else is societal self-indulgence, the very thing that keeps people commiting crimes.

crime, sometimes people could have intentions of killing someone but only seriously wounding them, so they would get assault instead of murder

wasn't that Hamurrabi's code? "an eye for an eye, an arm for an arm"? i think it is...
in some cases yes, like i think if u kill someone, they should kill you straight off, but in other cases no, like stealing should not result in death (1 of hamurrabi's laws)
