a few evening's ago a man jumped my front gates and was walking around my property.....

now...my private security took him down (their licenced as Private Security)

now today i got a call from my assistant saying 2 of my security were being sued ....

is this possible..because i have it all on my cctv system so theirs proof that they were just doing their job....


so is it possible for them to be sued (no physical harm was put towards him)

ok, ive had 1 answer saing he'll win...and 1 saying he wont.

im meeting with my lawer tomorrow to review the tapes.

Anybody can sue anybody for anything. Does he just think you have big money and you'll pay him off to avoid trial? Questions - has he been there before? Did anyone know him? If yes, why was he restrained this time? Have others jumped the gate with no consequences? If so, why him? What do you think he will sue for - harmed in any way? Excessive force? Was he carrying a knife, firearm, or anything that looked like a weapon? If so deadly force was authorized, and should have been used to avoid being sued.

He can sue, but I doubt he'd win if you have the video tapes showing that he was on your property and that you can assert that neither you nor your representatives (i.e. your security team) gave him permission to be there.

But the video tapes have to show they didn't overdo it with the violence, and if he has no injuries I think they probably will. If you have a no trespassing sign up I would suggest taking a couple of pictures of that (one up close to show what it says and one farther away to show its position--to show the other guy was warned not to be in there). I'm fairly certain you won't absolutely need it but the presence of pictures will help in this case.

But at no time should you discuss this with anyone except your lawyer. And your lawyer should be the one to get the story from your guards, hopefully they wrote some kind of report on the whole thing as well. But your lawyer should know which questions to ask so he can make a proper defense in court.

Get a lawyer, and don't worry, you win, they lose. After all, they came to your place and invaded your castle, as it were. CCTV evidence is enough to get him slam-dunked.
