I have a friend who was recently fired from his job. He returned all company uniforms and tools. His employer is now with holding his last paycheck because the employer states that my friend still has uniforms that he has not returned.

Employer can hold paycheck due to uniform. Your friend has to provide proof that he has returned everything.

Well the laws may vary by state. But I don't think they can hold his check because they think he has some of their uniforms. I know when I worked in HR/ payroll we had to make sure we got people their last paycheck on time. Though they no long work for that company they are supposed to get their check the same time as everyone else.

What state is he in? I may see if I can get some additional info.

the employer has to have documents signed by the employee stating the number of uniforms loaned. once returned that document has to be signed and checked off in order to get the paycheck. if your friend hasn't returned all of the uniform he has to pay for it otherwise its concidered stealing. if no document was signed, then the employer cannot hold the paycheck. they just have to concider it a loss and learn from their mistakes.

You answered your own question, they have some kind of written statement signed when uniforms are issued to hold the last check until all uniforms are returned. McDonalds has held a check of mine for 15 years for that reason.

Employers can withhold tour paycheck if you have uniforms,owe for damages,meals ate or any number of other things.Perhaps your friend misplaced a uniform.Maybe he still has tools.If your friend is still in doubt have him call a lawyer,the consultation is free with most.Good luck.

I believe that if you owe the company for anything, health ins., uniforms, meals, etc. they are entitled to take it out of your final paycheck. Contact your local labor dept. they'll answer any questions.

the employer cannot hold his paycheck. he worked for the money, which he is entitled to. you have to have proof that uniforms and such were taken back.

He has to return the stuff he signed for otherwise the company has to give the money over.

I don't believe they can with hold his entire pay check, they may be aloud to deduct what is owed in way of uniforms though.

no, if they do contact your local labor board. My last employer didn't give me last paycheck until I called the labor board and they threatened to take them to court if they didn't pay.
