was scheduled for back surgery was put under anesthesia dr was ready to make incision when ann=esthesia machine failed and they had to bring me out of anesthesia and surgery was not done. now i have to suffer another month before surgery any rec ourse that i can take this means another month out of work and my finances cant handle that

that's not malpractice,that's good practice...so would you have preferred for them to operate with inadequate anesthesia..its frivolous issues like this that has the medical community in such a mess..its understandable that you would be upset,out of work longer but no physical harm was done to you...had they continued the procedure with inadequate equipment then you should be compensated for the pain and such

Let me get this straight. A machine that was designed to help you in surgery failed so the doctors made the decision to stop so they don't cause you any harm and your upset about this?

The doctors did not do anything negligent to cause you harm that is the basis of any medical malpractice case. A machine failure is negligence because machines break down anytime.

You could go to court but it is going to take a minimum of a year before anything happens anyway.

You really do not have a case. You'd be lucky to get a lawyer to take on this case that isn't an ambulance chaser that will sue anything in pants. Even if you do get a lawyer it would most likely get thrown out of court.

Machines fail sometimes, the doctor didn't do anything wrong or harmful to you. What happened is unfortunate, but not malpractice, in fact they did the right thing in bringing you out and rescheduling you.

Sorry Elie but equipment failure is not grounds for damages unless the operator acted irresponsibly and ignored the malfunction.
The alternative would have been a lot worse if they had continued with the procedure.

believe me ,you wouldn't want the surgery ,without anesthesia.and furthermore , no doctor will do the operation without the anesthesia.

If you haven't suffered a permenant injury you have no basis for a suit.
