If you told your spouse that you were out of money and would do almost anything to get enough for your family. Then you were wrongly accused of robbery. Do you think your spouse should be made to take the witness stand and testify against you?

No, that is why our court system doesn't make a spouse testify against another spouse. There are things you say to your spouse, like a preist or doctor (actually you tend to say even more to your husband).

Just think about how many intimate secrets our spouses know about us.

There is a spousal privelege for anything you've said to your husband/wife, as long a there was no third party present when you made the statement. However, the prosecutor can ask about where the two of you were during the time the alleged robbery took place. Bottom line, any statements you made to your spuse in privacy are protected by law. It's the same as statements you've made to your doctor or lawyer.

Even if the wife did have to testify, she could bring up any number of other points...

But fortunately, she isn't required to testify.

spouses can not be required to testify against their mates...Its similar to the 5th amendment rights against self incrimination...it is extended to include only spouses.

NO, sounds like to me the wife was setting him up because it sounds like that she was not out working to help make some money. So i don't want her on the stand trying to prove I done it so she can go live with her boyfriend
