Do you feel the woman that won her lawsuit by suing the company that served her hot coffee ( after she spilled her own cup of coffee ) should have won her case ??

No, but sometimes corrrupt judges in this country allow these type of suits to be won in favor of the plaintiff so they can get a kickback or two - in my most humble opinion.

If memory serves, the clown people were then serving their coffee about 20 degrees hotter than your average cuppa Joe. If she didn't know that, I think she had a decent case. On the other hand, despite the severity of her injury, the award may have been excessive. Details are lacking. For instance, were they serving their coffee that hot to make its taste competitive while using lower-quality beans? Did she get their coffee often? The devil's in the details.

The manufacturer/distributor of the product should be held liable--the case history regarding product liability is clear--manufacturers, distributors, etc are all held stricitly liable for inadequate warnings. This being no secret, they should have placed warnings on the cup. I don't think the problem with this situation lies with the court or the finding, but to the level of stupidity man was dropped to

she's been getting coffee there for 20 years. She should know that the coffee was hot.

The court decided on the case and it is presumed that she had valid reasons to claim compensation. According to law, it is presumed that the court diligently ruled on the case based on valid issues unless proven otherwise.
